Terms of Service:In order to assure a mutually beneficial and clear working relationship, Elise Web Design asks that all potential clients read these Terms of Service before they order any services. Ordering any of our services will be regarded as agreement with and acceptance of these Terms of Service. Web Design: 1. Elise Web Design will submit estimate for web site design to client and discuss outline options. Upon acceptance of estimate and outline, work on the site will begin. 2. A test site will be made for client's approval during design stage. If changes are made after acceptance of web site, it falls under the maintenance agreement.This does "NOT" include a redesign of the site. In this case it is considered a new site design. 3. If the contract is cancelled before completion of site, all man hours towards completing the project are billed, including graphics and add-ons options. 4. Upon completion of site, the client will have 5 days with in which to notify Us of acceptance or rejection of site. If client does not notify us within 5 days, We will consider the lack of notification as acceptance of site and client will be billed as agreed upon. 5. EliseWD will upload site to host server (Elise Web Design Hosting or client's choice) at witch time an invoice will be given/sent to the client. Hosting: 1. EliseWD Does Not Allow Sending of Unsolicited E-mail (SPAM) First offense will result in immediate termination of account. If this occurs the unused portion of your account will not be refunded. 2. EliseWD reserves the right to cancel your service if your account goes beyond 30 days past due. Elise Web Design will charge a $50.00 reinstate fee to your account paid in advance. After a second disconnection, The account will be terminated unless other arrangements have been made. 3. EliseWD Is not responsible for maintaining an inventory of products within our system. Update text and photos must be sent with update request. 4. EliseWD will make all updates in a timely manner. usually within 48 hours. Accuracy of Site Content: Elise Web Design strives to ensure that all content of sites designed by us are accurate and correct but we assume no responsibility for errors in any information, prices, and/or descriptions within the customers web site. EliseWD will notify the customer when changes or edits are made to their site and it will be the customers responsibility to review the changes for accuracy. Outages and Disruption of Service: Although not anticipated there are times when a site may be down for reasons out of the control of Elise Web Design including but not limited to natural disasters, damaged fiber optics, local provider outages, etc. The Success of your Site: Elise Web Design makes no guarantee as to the success of your site and/or the search engine position of your site. Many factors including but not limited to pricing, demand, search engine position, etc. impact your sites success. Your position depends greatly on the number of other sites in the same category, time your site has been up and other factors we have no control of. Billing: Unless otherwise arranged, All payments will be due 14 days from date of invoice. A late fee of 10% per month will be assessed on overdue accounts. In the event of non-payment Elise Web Design reserves the right to suspend the customers Website, lock all access to the servers and place a hold on the customers domain name until the customers account is paid in full. Elise Web Design reserves the right to use all legal means to collect on outstanding accounts. There will be a charge of $25.00 for all returned checks. After 2 returned checks, a credit card number will be required in order to continue services. If a credit card is refused the site will be suspended as stated above. Changes to Terms of Service: Changes to the above terms of service may be made at any time and without prior notice. It will be the customers responsibility to read and understand the revised terms of service.
Agreement to TOS:Our Terms of service are binding and in place at all times unless
arrangements are made with Elisewd in advance. The Terms of Service
are subject to change without prior notice. |
